Terms
The terms of using Nan Made It, for makers and for customers.
1. About These Terms
These terms govern your use of Nan Made It (“Nan Made It”, “we”, “us”, “our”), trading under ABN 40 366 975 511 at nanmadeit.com.au. By opening an account, listing a piece or placing an order, you agree to them.
Nan Made It connects women over 50 who make things (“makers”) with the people who buy them (“customers”). Nan Made It is a marketplace: the contract for each sale is between the maker and the customer, not with Nan Made It.
Nan Made It And Madame Monet
Nan Made It is a social enterprise under Madame Monet, part of Lamoureux Lane. Madame Monet exists to create real financial power, income and community for Australian women aged 50 and over. Nan Made It’s sister, Nan Made, is for baking; Nan Made It is for everything else a woman makes.
2. Definitions
- “Maker” means an approved seller with a shop on Nan Made It.
- “Customer” means anybody who browses, orders or buys through the marketplace.
- “Listing” means a piece a maker offers for sale.
- “Order” means a customer’s request to buy a listing, processed through the marketplace.
- “The Lending Table” means the part of the marketplace where makers offer tools, materials and equipment to one another.
- “Marketplace” means the Nan Made It website, a maker’s studio, and everything that goes with them.
3. Who Can Open A Shop
To open a shop on Nan Made It you must:
- be a woman;
- be aged 50 or over;
- be an Australian citizen or permanent resident, or otherwise lawfully entitled to live in Australia and run a business here; and
- be legally entitled to make and sell your work under the laws of your state or territory.
Nan Made It is a special measure under section 7D of the Sex Discrimination Act 1984 (Cth) and section 33 of the Age Discrimination Act 2004 (Cth), provisions that permit programs designed to redress genuine, documented disadvantage for a group. Nan Made It exists to redress the well-documented economic disadvantage faced by women aged 50 and over in Australia, including a disproportionate risk of homelessness, a persistent gender superannuation gap, and age discrimination in employment. The maker’s side of Nan Made It, including The Lending Table, is reserved for women meeting the criteria above. Anybody may buy.
4. Your Account
You are responsible for keeping your sign-in details private and for everything that happens under your account. You must give accurate, current information when you join and keep it up to date. You can change your own details from your account at any time.
5. The Maker’s Fee And Payments
- A maker’s first month is free. The $10 a month fee applies from the second month, to keep her shop open.
- Makers keep 100% of the price of every piece sold. Nan Made It charges no commission on sales, ever.
- Payments are processed through Stripe. Stripe applies its own standard processing fee to each payment, which is separate from, and not charged by, Nan Made It.
- A maker’s sales are paid to the bank account she nominates, typically within two to five business days of the sale.
- A maker must finish setting up Stripe from her studio before she can be paid. Listing a piece does not, by itself, enable payment.
- A maker can stop paying at any time from her account. Her shop stays open until the end of the month she has paid for.
6. Everything Happens Here
All orders, all messages between makers and customers, and all payments must happen through Nan Made It. Arrangements made outside it (private messaging, direct bank transfer, cash in hand, or any other channel) are not permitted.
This rule protects both makers and customers: every sale is traceable through Stripe, Nan Made It can help with a dispute, and every maker has a clear record of her own income. Nan Made It cannot assist with, and takes no responsibility for, any arrangement made outside the marketplace.
7. What A Maker Is Responsible For
As a maker, you alone are responsible for:
- Holding a valid Australian Business Number where one is required.
- Making sure every listing is accurate: what the piece is, what it is made of, its size, and how to care for it.
- Complying with any law that applies to your particular craft, materials or business structure, including product safety standards for anything made for children or worn against the skin.
- Meeting your own tax obligations, including registering for GST if your turnover requires it.
- Packing and sending, or handing over, each piece as agreed with the customer.
Nan Made It does not inspect or certify any maker’s work, workshop or compliance. Makers are independent business owners, not employees or agents of Nan Made It.
8. What A Customer Is Responsible For, And Entitled To
As a customer, you are responsible for:
- Giving accurate order, contact and delivery or pickup details.
- Writing to makers through the marketplace only.
- Keeping to any pickup or delivery arrangement, or telling the maker promptly through the marketplace if you cannot.
- Treating every maker with the care, patience and respect you would want shown to somebody in your own family. Makers are independent women running their own small businesses, not staff of Nan Made It.
You are entitled to an accurate listing and a piece that matches its description. Your rights under the Australian Consumer Law are set out in full in the Nan Made It Refunds And Returns policy, and nothing in these terms reduces them.
9. The Lending Table
The Lending Table is where makers offer one another tools, materials and equipment they are not using. Nan Made It does not charge for it and takes nothing from it. Whatever two makers agree about a loan, a swap, a gift or a fair price for it is between the two of them, and Nan Made It is not a party to it. Each maker is responsible for the condition of what she offers and for returning what she borrows as agreed.
10. Orders, Cancellations And Refunds
Cancellation and refund entitlements are set out in full in the Nan Made It Refunds And Returns policy, which forms part of these terms. Nothing in these terms limits a customer’s rights under the Australian Consumer Law.
11. Account Standing, Complaints And Suspension
Nan Made It distinguishes between an accidental, minor issue and a genuine, verified complaint. Verified complaints are recorded against a maker’s account. Repeated or serious verified complaints may result in a maker’s account being suspended or closed, at Nan Made It’s reasonable discretion, after she has had the opportunity to respond.
12. Your Work Is Yours
The Nan Made It name, logo and design are the property of Nan Made It. Makers keep ownership of their own work, their photographs and their words, and give Nan Made It a licence to display them on the marketplace for the purpose of running it.
13. Limitation Of Liability
To the maximum extent the law permits, Nan Made It’s liability for any claim arising from use of the marketplace is limited to the fees paid by the relevant maker in the three months before the claim. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
Nan Made It is not a party to the contract of sale between a maker and a customer, and does not guarantee the quality, safety or legality of any listing. Its role is to provide the marketplace and to facilitate payment through Stripe.
14. Indemnity
Each maker agrees to indemnify Nan Made It against any claim, loss or liability arising from her work, her conduct or her breach of these terms, to the extent the law permits.
15. Privacy
How we collect, use and look after personal information is set out in full in the Nan Made It Privacy policy, which forms part of these terms.
16. Changes To These Terms
Nan Made It may update these terms from time to time. Material changes will be notified to makers and customers by email or on the site. Continuing to use the marketplace after a change takes effect is acceptance of the updated terms.
17. Closing An Account
Either party may close an account at any time. Nan Made It may suspend or close an account for a breach of these terms or of the law.
18. Governing Law
These terms are governed by the laws of Victoria, Australia, and each party submits to the non-exclusive jurisdiction of the courts of Victoria.
